Prospects for the development of the legal system of «New Kazakhstan» in the context of the implementation of the concept of legal policy

Abstract

The article discusses the prospects for the development of the legal system of» New Kazakhstan «based on the historical legal aspect. In the context of the modernization of all aspects of the legal system, the organizational and creative role in the rule of law is considered as one of the optimal tools for managing social processes. At the same time, it requires new solutions related to the study of the content and essence of modern law, its functions, social value, the mechanism of Legal Regulation and its effectiveness, the laws, and trends in the development of domestic law, the application and implementation of the law, allowing to more deeply
reveal the relationship of the legal form with the content of regulated public relations. It is the basis for the development of relevant programs in the field of legal policy of the state, long-term and annual plans for legislative work, and regulatory legal acts of the country. The article focuses on ensuring the effective functioning of institutions of state power, which are the most important means of achieving state-legal tasks. Therefore, without a proven policy, strategy, and tactics in the legal field of the country, there can be no purposeful, planned activity in any area of public life. We believe that the concept, which determines the main priorities of the country’s legal policy for the coming years, should be aimed not only at the active improvement of branches of law and the formation of a new generation of Kazakhstan’s legislation but also at the effective work of judicial and law enforcement agencies on the real protection of citizens’ rights and freedoms.
