Ecologization of labor legislation: status and prospects

The article covers the state and prospects of ecologization of Kazakhstan’s labor legislation. Analysis of the content of applicable concepts in Kazakhstan: transition to a «green» economy, to sustainable development; increase in income of population until 2025, labor safety, etc. allowed the author to conclude that there are no provisions related to ecologization of branches of legislation, except environmental; with environmental education of subjects of labor law. According to basic indicators of objective measurement of decent work developed by labor scientists, the author offers to take them as a basis for ecologization of labor
legislation. It includes the reasons for the absence of a comprehensive approach to solving the global problem of creating a «green» economy in the country.
The ecologization of labor legislation is proposed to start with an analysis of its current norms, in particular, a revision of their goals and objectives, principles, as well as provisions concerning environmental protection and environmental safety in the labor process. It is proposed to revise the section «Safety and labor protection»: give a new definition of the concept of «labor protection» with the introduction of environmental measures, revision of rights and obligations, and responsibilities of the parties to labor relations. Considering that one of the reasons for the deterioration of the ecological situation in the country is a low level of environmental
education of employees and employers of organizations related to environmental management, it is proposed to establish at the legislative level the obligation of these persons to be trained in environmental protection and compliance with environmental safety.
